DACA: Protection for Dreamers

Deferred Action for Childhood Arrivals (DACA) is a program that provides protection from deportation and work authorization to individuals who were brought to the United States as children.

Requirements

• Arrived in the U.S. before age 16
• Continuously resided in the U.S. since June 15, 2007
• Were physically present in the U.S. on June 15, 2012
• Were under 31 years of age as of June 15, 2012
• Currently in school, have a diploma, or have served in the military
• No serious criminal convictions

DACA is granted for 2 years and may be renewed.

Form I-821D

File Form I-821D together with I-765 (EAD) and I-765WS (worksheet). The filing fee is $495. Submit your renewal application 120–150 days before your current period expires.

• School records, diplomas, transcripts
• Medical records establishing presence in the U.S.
• Bank statements, payment receipts
• Affidavits from acquaintances

DACA provides significant benefits, but it also comes with important limitations.

What DACA Provides

• Protection from deportation (deferred action)
• Work authorization (EAD)
• SSN — you may obtain a Social Security Number
• Driver's license — available in all states

Limitations

• Does not confer lawful status — it is not a visa or a green card
• No direct path to citizenship through DACA alone
• Federal financial aid for education is not available
• International travel — permitted only with advance parole, on limited grounds
