With Legal Status

All individuals with a legal immigration status are eligible to obtain a driver's license. The validity period typically matches the expiration of their authorized period of stay.

Undocumented

19 states and DC issue driver's licenses or driving privileges regardless of immigration status, including:

• California, New York, New Jersey
• Illinois, Connecticut, Washington
• Colorado, Maryland, Nevada

These licenses are marked "Not for Federal Purposes" and cannot be used to board a domestic flight.

The general process for obtaining a driver's license is the same for everyone.

Steps

1. Gather your documents — proof of identity, proof of address, SSN (if applicable)
2. Visit the DMV — schedule an appointment online to save time
3. Pass the written test — available in many languages, including Spanish
4. Obtain your learner's permit
5. Practice driving — with a licensed driver
6. Pass the road test

Starting in 2025, a REAL ID is required to board domestic flights and enter federal buildings.

Who Can Get a REAL ID

• Proof of lawful presence (visa, green card, EAD)
• SSN
• Two proofs of address

Standard License vs. REAL ID

• REAL ID — marked with a star, accepted by TSA
• Standard — no star, valid for driving purposes only
