K-1 Fiancé(e) Visa

The K-1 visa allows the fiancé(e) of a U.S. citizen to enter the country to get married within 90 days.

Key Requirements

• Petitioner — must be a U.S. citizen (not a lawful permanent resident)
• In-person meeting — the couple must have met in person within the past 2 years
• Both free to marry — neither is currently married; any prior marriages have been legally dissolved
• Intent to marry within 90 days of entry

Exceptions to the In-Person Meeting Requirement

In exceptional circumstances (cultural or religious customs, or extreme hardship), the in-person meeting requirement may be waived.

The process begins with the U.S. citizen filing Form I-129F.

• Form I-129F
• Proof of the petitioner's U.S. citizenship
• Photos of the couple together
• Evidence of the relationship (correspondence, calls, trips)
• Proof of the in-person meeting
• Filing fee — $675

Processing Times

The I-129F is processed by USCIS in approximately 8–14 months; the case is then transferred to the NVC and on to the consulate for an interview.

After entering on a K-1 visa, you must get married within 90 days and then apply for a green card.

Steps After Entry

1. Get married within 90 days
2. File I-485 (Adjustment of Status)
3. File I-765 (EAD) and I-131 (Advance Parole)
4. Biometrics and interview
5. Receive a conditional green card (valid for 2 years)

Conditional Green Card

If the marriage is less than 2 years old at the time the green card is granted, it will be issued on a conditional basis for 2 years. Within the 90-day window before it expires, file Form I-751 to remove the conditions.
