What if you hold a green card and get arrested at the border? That question became very real on September 28, 2026, when U.S. Customs and Border Protection (CBP) officers at the Del Rio International Bridge in Texas stopped a 59-year-old lawful permanent resident (LPR) — a person who holds a green card — driving a 2018 Ford Transit Van. Officers referred the vehicle to secondary inspection and found 81 packages of methamphetamine hidden inside the driver-side quarter panel. The drugs weighed 64.73 pounds and carried an estimated street value of $595,185. Homeland Security Investigations (HSI) special agents arrested the driver and opened a criminal investigation.

Port Director Liliana Flores of the Del Rio Port of Entry confirmed the seizure, saying CBP used a "layered enforcement strategy" that included a nonintrusive inspection system — essentially an X-ray-style scanner — before officers conducted a physical search. The arrest shows that CBP screens vehicles driven by LPRs just as it screens anyone else crossing the border.

How a drug trafficking charge can end a green card

A drug trafficking conviction is one of the most serious immigration consequences a green card holder can face. Under U.S. immigration law, drug trafficking is classified as an "aggravated felony" — a legal term that triggers mandatory deportation (called "removal") with almost no exceptions. An LPR convicted of an aggravated felony loses the right to apply for most forms of relief in immigration court. That means no cancellation of removal, no asylum, and in most cases no voluntary departure. The government can also bar the person from ever returning to the United States.

What to do

  • If you or a family member is an LPR facing a drug-related arrest, contact a criminal defense attorney and an immigration attorney immediately — criminal and immigration cases run on separate tracks, and a plea deal that seems minor in criminal court can still trigger deportation.
  • Do not plead guilty to any charge without first asking an immigration lawyer how that plea affects your green card. Even a misdemeanor drug conviction can have serious immigration consequences.
  • If removal proceedings begin, you have the right to appear before an immigration judge. You have 30 days from a removal order to file an appeal with the Board of Immigration Appeals (BIA).
  • Ask your attorney whether a motion to reopen (which must be filed within 90 days of a final removal order) applies to your situation if new evidence or legal arguments are available.
